Right holders of the cartoon series Peppa Pig have been protecting the series since it came into existence; the creatorssued an online shopping store Jufan Limited and the producer Jiale Toys Industrial.
The creators had registered Peppa Pig in United States Of Americaon August 19,2005,furtherthe creators had applied to National Copyright Administration of China for the registration of the copyright of Peppa Pig, George Pig, Daddy Pig, Mommy Pig and obtained the certificate of registration of the work.
The creators took an action when they came to know that online store Jufan Limited had listed toy kitchen set on Alibaba’s much-hyped marketplace.
The toy kitchen set was decorated with Peppa Pig’s images without seeking any license or permission. Further, this case was taken to the one of its kind Hangzhou Court of The Internet. This case will be the first ruling on the production of copyright infringement by this newly established internet court.
Abeida Company and Entertainment Co., Ltd. believed that their company had never authorized the sale of the alleged infringing products involved in the case and displayed relevant pictures. The producer Jiale Toys Industrial had produced and sold the alleged infringing products involved in the case without any authorization.
The Hangzhou Internet Court believed that “Peppa Pig, George Pig, Daddy Pig, Mommy Pig” present beautiful characters and artistic effects in lines, colours or combinations. It is original and is protected by the copyright law.Taking this into consideration, the infringing company was sentenced immediately to stop the infringement and compensate for the economic loss in 150,000 Yuan, to the creators of Peppa Pig.
